Categories of Personal Data Processed by Bruxless

1. Personal Data Processed When You Create a Bruxless Account

When you create an account, we ask for your account identifier (ID), your name, and your password. The account ID and primary contact method correspond to your email address. If you prefer, you can provide only your first name or a nickname. We may also ask you to provide a date of birth or another means of contact, such as an alternate email address or a mobile phone number.

Purposes and Legal Bases

  • We collect and process your account ID and password solely because you use them to log into your account. The legal basis for processing your account ID and password for this purpose is based on our legitimate interest in ensuring the security of your account.

  • We process your contact data to send you important information about your Bruxless products, services, applications, or accounts, such as critical safety warnings or potential significant changes made to this Privacy Policy. The name you provide is associated with your account profile and is displayed when you send information requests to the Bruxless service. The legal basis for processing your contact data and your name for this purpose is based on our legitimate interest in providing you with important information, particularly regarding safety.

  • If you agree to receive direct marketing information from us, we will also process your account ID to send you marketing communications (e.g., emails, SMS) about our products, services, and applications, as well as newsletters. The legal basis for this processing is your consent. You can change your mind at any time and withdraw your consent by modifying your preferences in your Bruxless account or by clicking the unsubscribe link.

  • The marketing communications you receive from us are based on the preferences indicated in your account. The legal basis for processing this data is our legitimate interest in reducing the volume of marketing communications sent to each customer by selecting customers who wish to receive certain types of communications, thereby avoiding sending every marketing communication to all customers.

  • We process contact data to associate it with your account when you interact with our customer support team. The legal basis for processing your email address is based on Bruxless's legitimate interest in providing you with a high-quality customer support service.

  • We process contact data to inform customers who violate our terms. The legal basis for this processing is based on our legitimate interest in ensuring a high-quality experience for all our customers and ensuring compliance with our terms.

2. Personal Data Processed When You Synchronize Your Bruxless Headset

When you synchronize your headset directly or via the Bruxless application, we record data regarding the transfer, the date and time of synchronization, error/diagnostic logs, sensor values recorded when the headset is worn, software information about your headset, and the battery charge level of the headset.

Purposes and Legal Bases

  • We process this information to simplify the identification and resolution of errors or synchronization issues. The processing of this data for this purpose is legally justified by our legitimate interest in resolving errors and synchronization issues and providing you with quality product support.

3. Personal Data Processed When You Communicate with Bruxless

If you communicate with a consultant from our customer support service by email, telephone, or online, we collect personal data such as your name, postal address, telephone number, email address, and contact preferences, as well as information about the products you own (such as their serial number and date of purchase) and the subscriptions you have purchased. We may also create event logs used to diagnose product or application performance issues and to collect information regarding a support or service issue.

In compliance with applicable law, we may also record and listen to your conversations with our customer support consultants, as well as analyze any feedback voluntarily provided via customer surveys, all for the purpose of improving our customer service. With your agreement, our customer support consultants may log into your account if resolving issues related to your account requires it.

  • We use this information to provide you with customer and product support. We also use it to monitor the quality and type of support we provide and to facilitate repairs, returns, or exchanges. The processing of this data is legally justified by our legitimate interest in providing you with high-quality product support. The legal basis for allowing consultants to log into your account is the necessity of this connection to resolve your problems, based on your consent, which you can withdraw at any time.

4. Personal Data Processed When You Purchase a Product

If you purchase a headset on the Bruxless website, through an application, or via customer support, we collect your name, address, email address, and telephone number, as well as any other information necessary for billing in your jurisdiction. We do not see or store your payment card information, which is handled exclusively by third-party service providers.

Purposes and Legal Bases

  • We collect your name, postal address, and telephone number to process and ship your order. The legal justification for this processing is the performance of a contract.

  • We also process your personal data as part of our fraud detection processes, which may include using personal data related to the purchase, delivery, or use of products, services, or subscriptions, if necessary to investigate requests or claims. The legal justification for this processing is our legitimate interest in protecting our entity and our customers against fraudulent transactions.

Categories of Third Parties Receiving Your Personal Data

Service Providers

  • Shopify: We use Shopify's commercial platform service to sell Bruxless headsets, manage product pages, shopping carts, orders, inventory, and customer relations.

  • AWS (Amazon Web Services): We use AWS cloud services to back up data sent by the Bruxless headset.

  • Klaviyo: We use Klaviyo to send emails to our users in support of the functionalities described in this Privacy Policy.

  • PayPal: We use PayPal as a third-party payment platform.

When you create a Bruxless account, add personal data to your account profile, or upload data to your account, your personal data is collected and stored on servers located in Europe.

Rights Relating to Personal Data Processing

The data subject is informed that, for all the aforementioned purposes, they possess and can exercise the following rights with Bruxless:

  • The right to request that Bruxless access their collected personal data and rectify it or restrict its processing.

  • The right to the erasure of their personal data when it is no longer necessary for the purposes for which it was collected.

When the legal basis for processing is legitimate interest, the Customer is informed that they can exercise the following additional rights:

  • The right to object to the processing of their data unless Bruxless demonstrates compelling legitimate grounds that override the interests, rights, and freedoms of the Customer.

  • The right to erasure at any time if Bruxless has no compelling legitimate grounds to retain it or is not required to retain it by a legal obligation or for the establishment, exercise, or defense of legal claims.

When the processing is intended for commercial prospecting (marketing), the customer has an absolute and unconditional right to object to the processing of their data and request its erasure at any time.

When the legal basis for processing is the execution of the GTC (Terms of Sale), the customer is informed that they have the right to data portability.

Right to Lodge a Complaint with the CNIL
